Client Agreement
This serves as an agreement between you and Bright Harbor Recovery, Inc. to perform services related to natural disaster recovery.
Bright Harbor is a disaster recovery service provider. Bright Harbor is not a public adjuster, general contractor, insurance broker, or lawyer. It will never provide public adjusting services, negotiate insurance claims on your behalf, or offer legal advice. In cases where services requiring licenses are required, Bright Harbor can, at your request, introduce you to capable individuals.
Services Provided: Bright Harbor provides a comprehensive disaster recovery service to support you throughout the entire recovery process. Our service includes access to a dedicated recovery specialist who will guide you every step of the way, as well as assistance in locating and managing a wide range of resources essential for recovery.
Fees: The navigation service is offered to you free of charge. Should you require additional services beyond navigation, they will be provided upon your request and subject to fees. You acknowledge that Bright Harbor may receive compensation from third-party vendors who use its platform and perform work on your behalf.
Client Responsibilities: You agree to provide accurate and complete information as required by Bright Harbor to perform the services. You are responsible for promptly communicating any changes in your situation or needs to your recovery specialist. Both parties will abide by the responsibilities set forth in the Terms of Service and Privacy Policy.
Limitation of Liability: To the maximum extent permitted by law, Bright Harbor shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the services provided, even if advised of the possibility of such damages. Bright Harbor’s total liability under this agreement shall not exceed the amount of fees paid by you for the services.
Governing Law: This agreement is governed by and construed in accordance with the laws of the state of Texas. If the laws of the state where your property is located take precedence over Texas law, then those laws will apply. However, jurisdiction and venue for any disputes will be in Travis County, Texas.
Entire Agreement: This agreement constitutes the entire agreement between the parties and supersedes all prior understandings or agreements, whether written or oral, regarding the subject matter herein. Any amendments to this agreement must be in writing and signed by both parties. Bright Harbor reserves the right to modify the Services from time to time, provided that such modifications do not materially diminish the functionality of the Services.
Severability: If any provision of this agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Acceptance: By signing up for our service, the Client acknowledges that they have read, understood, and agree to the terms and conditions of this Agreement.
